AE4cast is a Delaware-registered company that operates a data analytics platform providing AI-powered crop yield forecasting and agricultural market intelligence to business customers. This website is a marketing site used to describe those services and collect demo requests. Paid access to the platform is subject to a separate commercial agreement.
3. Nature of Forecasts — Not Financial or Trading Advice
AE4cast provides AI-powered statistical models and probabilistic crop yield forecasts. All forecasts, projections, signals, and data outputs ("Forecast Content") are provided for informational purposes only.
Forecast Content does not constitute financial advice, investment advice, commodity trading advice, or any form of regulated advice. AE4cast is not a registered investment advisor, commodity trading advisor (CTA), or broker-dealer under any applicable law.
Past forecast accuracy is not indicative of future results. Agricultural outcomes are subject to factors beyond the scope of any model, including unforeseeable weather events, geopolitical disruptions, and market forces. You assume sole responsibility for any trading, hedging, purchasing, or business decisions made in reliance on Forecast Content. AE4cast expressly disclaims liability for any losses arising from such reliance.
4. Acceptable Use
By using this website and any AE4cast services, you agree not to:
- Scrape, crawl, or systematically extract data or Forecast Content from the platform or website
- Reverse engineer, decompile, or attempt to derive source code, underlying models, or methodology
- Redistribute, resell, sublicense, or publish Forecast Content to third parties without prior written consent from AE4cast
- Use the service in violation of any applicable local, national, or international law or regulation
- Impersonate any person or entity, or misrepresent your affiliation when submitting a contact or demo request
- Attempt to gain unauthorised access to any part of the website or its infrastructure
5. Intellectual Property
All content on this website, including text, graphics, logos, and Forecast Content, is the exclusive property of AE4cast and is protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable licence to access the website for your own internal business purposes only. You may not modify, copy, distribute, transmit, display, reproduce, or create derivative works from any AE4cast content without prior written permission.
6. Data Usage
AE4cast does not use personal information submitted via contact or demo request forms to train AI models. We may use aggregated, anonymised usage data to improve service performance. How we collect and use personal information is described in our Privacy Policy.
7. No Accounts — Marketing Site Only
This website does not currently offer user accounts. If you become a commercial customer and receive account credentials to access the AE4cast platform, you will be responsible for maintaining the confidentiality of those credentials and for all activity occurring under your account. Account responsibility obligations will be detailed in your commercial agreement.
8. Age Restrictions
AE4cast's services are intended for business use by adults. We do not knowingly collect personal information from individuals under the age of 13. Users under the age of 18 require parental or guardian consent to use the service.
9. Subscriptions and Refund Policy
Access to AE4cast's data platform is provided under paid subscription agreements negotiated separately with each customer. Subscription terms, pricing, and cancellation conditions are set out in those commercial agreements. As a general policy, cancellations made after 30 days of service will not qualify for a refund of fees already paid unless otherwise agreed in writing.
10. Disclaimer of Warranties
THE AECAST WEBSITE AND ANY SERVICES DESCRIBED HEREIN ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AECAST DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT FORECAST CONTENT WILL BE ACCURATE AT ALL TIMES.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AECAST'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE OR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNTS PAID BY YOU TO AECAST IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).
IN NO EVENT SHALL AECAST BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Force Majeure
AE4cast shall not be liable for any delay or failure to perform arising from causes beyond its reasonable control, including natural disasters, satellite or remote-sensing data outages, failures of third-party data providers, cyberattacks, power failures, pandemic, or government actions.
13. Dispute Resolution
Before initiating formal dispute proceedings, the party seeking resolution must provide the other party with written notice describing the dispute in reasonable detail, and allow 30 days for good-faith negotiation to resolve it informally.
If informal resolution fails, any dispute arising from or relating to these Terms or your use of the service shall be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA), with proceedings taking place in Wilmington, Delaware. Costs and fees shall be allocated per AAA rules. Each party waives the right to participate in any class action, class arbitration, or representative proceeding.
Note: This arbitration clause is provided as standard boilerplate and should be reviewed by legal counsel before commercial launch.
14. Governing Law
These Terms of Service are governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions.
15. Changes to These Terms
AE4cast reserves the right to update these Terms of Service at any time. When we make material changes, we will update the effective date at the top of this page. Continued use of the website after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AE4cast with respect to your use of this website. They supersede all prior agreements and understandings. Commercial customers are subject to additional terms set out in their subscription or data licensing agreements, which take precedence over these Terms in the event of conflict.
